O Projeto de Lei 5516/2019 foi retirado da pauta de quarta-feira do Senado Federal. Isso ocorreu porque o relator do projeto, o senador Carlos Portinho (PL-RJ), explicou que pelo grande volume de emendas que entraram, sua equipe precisou fazer um novo trabalho de justificativa do que será aceito e o que não será aceito.

O Senador destacou que, além de precisar renumerar todos os artigos, por causa de cada emenda aceita, ele procura justificar as emendas que foram recusadas. Assim, Portinho requereu que o PL fosse votado amanhã.O presidente da Casa e autor do projeto,Rodrigo Pacheco (DEM-MG), deferiu o pedido.

“Senhor presidente, caríssimos senadores. Quero primeiro agradecer a contribuição de todos com as suas emendas ao projeto da Sociedade Anônima do Futebol. Procurei e admiti a grande maioria das emendas, porque não alteravam substancialmente o projeto.

Ao contrário, aperfeiçoaram, principalmente, na parte das contrapartidas sociais, muitas das emendas, eu consegui aproveitar, quero aqui antecipar. E poucas tive que recusar, porque devo a cada um de vocês uma razão, um fundamento para isso. Eu, além de ter que renumerar todos os artigos, que a cada emenda aceita, a gente tem que fazer a correlação.

Procuro sempre justificar e bem justificar para que todos entendam aquelas poucas que foram recusadas. Em razão disso, embora todo o esforço – e quero registrar aqui da minha equipe – são bravos.

Mas o relatório final, com todas as emendas que foram admitidas está sendo apresentados agora e pela questão regimental, não vejo também prejuízo nenhum dele ser votado amanhã, como peço ao Senhor Presidente, para que amanhã a gente possa concluir a leitura do relatório e a votação”.

A transição de associação civil para Sociedade Anônima de Futebol (SAF) tem como objetivos atrair mais investidores e garantir maior transparência na gestão de clubes. Há também a expectativa de que exista um melhor gerenciamento de dívidas, especialmente as que possuem um caráter social, como as trabalhistas. A ideia é que exista profissionalização das gestões, que visem principalmente o lucro das instituições de futebol.

Diferente de outros projetos discutidos anteriormente, o PL 5519/2019 propõe um modelo societário diferente das demais empresas. Além de haver um período de transição em relação aos impostos, em que a carga tributária vai gradualmente aumentando, a proposta de criar SAFs oferece mais mecanismos de segurança aos investidores, como as debêntures do futebol, e direitos de voto e veto para sócios com menor participação.

O sumário executivo da SAF, que esclarece os detalhes da iniciativa, explica que o modelo de Sociedade Anônima foi escolhido porque, uma vez que operado sob instrumentos de controle, dificulta a inserção de “aventureiros” na gestão de futebol. O formato também garante a padronização do funcionamento de clubes-empresas e instrumentos de capitalização e financiamento próprio, como é o caso dos debêntures-fut.

NOVAS FORMAS DE QUITAR DÍVIDAS

O gerenciamento de dívidas é um dos pontos centrais da discussão. Nesse aspecto, os clubes podem optar por três formas: por meio de pagamento direto pelo clube, recuperação judicial (negociação coletiva) ou concurso de credores.

A centralização da execução dos passivos a partir de um concurso de credores (uma fila para os pagamentos), já ocorre há anos dentro e fora do mercado desportivo. A SAF propõe a definição de percentual mensal sobre as receitas para que não haja a necessidade de renegociação a depender do resultado esportivo, privilegiando as dívidas trabalhistas por terem caráter social.

O projeto também prevê “instrumentos de aceleração” antes não regulamentados, como a negociação de redução da dívida, conhecida por deságio. A cessão do crédito a terceiros e emissão de títulos para serem revertidos em pagamento também constam no relatório. Uma outra possibilidade é a conversão da dívida em ações na instituição.

TRIBUTAÇÃO ESPECÍFICA DO FUTEBOL

Quanto à tributação, o Marco Legal do clube-empresa traz outra novidade: a Tributação Específica do Futebol (TEF). Seu intuito é evitar o desequilíbrio entre clubes que adotarão ou não a SAF, chamado de doping financeiro reverso, e para permitir que clubes organizem o gerenciamento de dívidas sem prejuízo, os autores do PL diferenciam os impostos do clube das demais empresas.

COMO UM PROJETO DE LEI TORNA-SE LEI?

O projeto de lei é apenas o esboço de uma lei. Para que ela se torne lei é necessário que ela passe por uma comissão permanente para que ocorra a análise de seus aspectos.

Em seguida, com o ok da comissão, um relatório é feito e, então, a lei é votada. Com a aprovação na votação, caminhamos para a segunda fase. Logo, se a Casa Revisória aprovar, o projeto é enviado à Presidência da República (3ª fase).

No entanto, a Casa Revisora pode fazer uma emenda (o projeto, então, volta para a Casa Iniciadora que apreciará tudo de novo) ou pode rejeitar (assim, o projeto é arquivado, todavia pode ser desarquivado se pedido pela maioria da Casa).

Na terceira fase, o presidente pode vetar ou sancionar o projeto. Caso ocorra um veto, este deve ser fundamentado e justificado – total ou parcialmente – por prejudicialidade dos interesses nacionais ou por inconstitucionalidade.

Se o presidente, em 15 dias úteis a partir do recebimento do projeto para sanção, não comunicar o Senado Federal os motivos do veto, a presunção é de que houve sanção. Caso ocorra sanção, o projeto de lei enfim torna-se lei e deve haver uma promulgação em até 48 horas para dar conhecimento a todos.

The Dutchman is a vital presence in Postecoglou's back four, as his searing pace allows the Australian to deploy his favoured high line. When van de Ven was sidelined midway through the campaign, Spurs' winning run came to an abrupt halt and their form plummeted, leading to demands for chairman Daniel Levy to bring in a quality alternative.

They ended up putting pen to paper on a deal for Radu Dragusin for £25 million from Genoa, and many would've expected that transfer to mark the end of Spurs' search for new central defenders.

However, that actually isn't the case, as explained by Postecoglou himself.

“If you’re saying, ‘Is it an area we can strengthen?’, yes it’s an area we will probably look at”, said Postecoglou on signing another centre-back this summer.

“With all these things, it’s about trying to strengthen the group as much as anything else. If you think about when I first arrived, we had maybe six or seven centre-backs at the club. So it’s not just numbers. It’s more about the ability of those players to play the football we want and to fit in to what we’re trying to build here. I think it is an area of the park we will look to strengthen, but I think we’ll look to strengthen all areas of the park come the end of the season. That is planning that’s already underway, and other people are in charge of it at the moment.”

They've been linked with a few interesting options in that area of the pitch. Spurs are believed to be interested in Fulham defender Tosin Adarabioyo, and Bournemouth's Lloyd Kelly, as both top flight defenders could be available at zero cost with their contracts expiring in June.

As well as the soon-to-be free agents, a centre-back abroad who's turning heads at N17 is Bayer Leverkusen's Piero Hincapie.

Australia demolished New Zealand for the third match in a row to complete a 3-0 series sweep and a 5-0 home Test summer at an overcast SCG, also ensuring that every match – against New Zealand and also Pakistan earlier – finished inside four days.Set 416 for victory, New Zealand were in trouble quickly, losing Tom Blundell, Tom Latham, Jeet Raval and Glenn Phillips in quick succession on a wearing pitch. Nathan Lyon, alternating sharp spin and straighter deliveries with plenty of bounce, completed the job after tea with the help of some ordinary New Zealand batting and one stunning catch from James Pattinson, to claim ten wickets for the match.There was a sense of inevitability about the day, as the Australians benefited from a wide array of confident performers against a visiting side that has been battered on the field but also off it by illness and injury. It also served as a kind of greatest-hits package for the hosts, from David Warner and Marnus Labuschagne with the bat to Mitchell Starc, Lyon and Pat Cummins with the ball.Labuschagne finished the Test summer with no fewer than 896 runs from five matches, with Warner not too far behind him. Labuschagne was fortunate to survive the return catch he offered Astle soon after, but he was quickly into stride alongside Warner, as Australia pushed their lead close to 400 by the time of the interval. Crystal Palace are being rinsed by Pardew signing earning more than Wharton

It's been an interesting season for Crystal Palace this year, to put it diplomatically.

While the future looked rather bleak under Roy Hodgson's guidance just a few months ago, Oliver Glasner's appointment has breathed new life into the club, even if his brand of offensive football has yet to materialise in south London.

The signing of Adam Wharton has also given fans something else to celebrate, as the early signs look good. However, his modest wage makes another player's salary look absurd.

The Eagles completed the £18.5m signing of Wharton on February 1st after several weeks of back-and-forth negotiations, and while that was undeniably a lot of money for a then-19-year-old with relatively little experience, it already looks like a brilliant deal.

The "English Cambiasso", as talent scout Jacek Kulig described him, has featured in all eight games the club have played since his arrival, starting seven of them.

However, his first two Palace games were something of a trial by fire. He was substituted for an injured Marc Guehi against Brighton & Hove Albion before making his first start at home to Chelsea.

While he couldn't prevent the south Londoners from losing in either game, he did show glimpses of the talent that led to his signing. In the five games since, he has looked even more impressive, helping the club pick up six points from Glasner's first six games in charge.

In all, the "complete midfielder," as Kulig dubbed him, has already become one of the most important players at the club. So, the fact that he is earning a relatively modest – by football's standards – wage of £35k-per-week is excellent business from Steve Parish and Co.

That said, it does make the wage of one senior player in the squad look particularly perplexing.

James Tomkins' salary at Crystal Palace

The player in question is former West Ham United ace James Tomkins, who has been a Palace player for seven and a half years following his £10m move from the East London outfit in the summer of 2016, when Alan Pardew was at the helm.

It should be noted that the 34-year-old veteran has been an important player for the Eagles in the past and a consistently decent performer, racking up 135 appearances for the south Londoners during his stint at the club, but he has barely featured over the last two seasons.

Last year, he made just seven first-team appearances and this year, he's featured even less, making just four, amounting to 87 minutes – 84 of which came in a League Cup tie against Championship side Plymouth Argyle.

This lack of game time probably wouldn't be much of an issue if the former Hammer were on a low wage, but he is currently taking home £50k-per-week, which, when accounting for the seven and a half seasons he's been at the club, means he has cost Palace around £20.1m in wages alone, or £30.1m altogether when taking his transfer fee into account.

Ultimately, Tomkins has been a reliable defender for Palace over the years and should be appreciated by the fans, but it has been clear for a couple of years now that he needs to be moved on, especially when he's earning £15k-per-week more than one of the most promising players at the club.

Tom Cooper fell agonisingly short of his second Sheffield Shield century of the season, but his 99 helped South Australia to a strong position on day one against Western Australia at Adelaide Oval.Cooper was bowled for 99 by a cracking inswinger from Joel Paris with the second new ball. But his third half-century of the season, combined with his mammoth 271 not out against Victoria, took him past 600 runs for the competition and to the top of the run-scorers’ list. He struck 12 boundaries and played fluently to combine for an 80-run stand with Harry Nielsen, who made 53.Jake Weatherald was the third Redback to make a half-century as the home side piled up 8 for 352 after they were sent in to bat by Western Australia stand-in captain Shaun Marsh.WA made early inroads removing Henry Hunt and Callum Ferguson as the ball nipped and swung in the first hour. Weatherald and Travis Head counter-attacked with a brisk 86-run stand that featured 17 boundaries in just 20 overs, before Paris made the breakthrough forcing a mistake from Head to give wicketkeeper Josh Inglis his third catch.Weatherald fell to a stunning catch from Marsh at second slip after chasing a wide awayswinger from David Moody, and when Will Bosisto was also caught by Marsh off Moody, the Redbacks were 5 for 143.But Cooper and Nielsen steadied the ship. The latter looked very comfortable having replaced Alex Carey who is away on international duty, but after reaching his half-century, he fell in the same manner as Weatherald with Marsh taking his third sharp chance.Cooper looked set for a century but Paris swerved an inswinger back through the gate. South Australia’s tail wagged, though, with Chadd Sayers and Daniel Worrall both making valuable contributions. Sayers made 38 not out and combined with Cooper in a 48-run partnership before adding an unbeaten 38 with Worrall against the second new ball to frustrate the visitors and take the total beyond 350.
